'Choice of Mother': Delhi High Court Allows Woman to Terminate 33-Week Pregnancy

On Tuesday, the Delhi High Court stated that the right of a pregnant woman to terminate her pregnancy is a matter of global debate. But the bench, comprising Justice Mrs. Prathiba M. Singh, stated that India recognises the choice of women in its law.

 

The bench noted that it is the ultimate choice of the woman to either give birth or abort the fetus. The petition was filed by a 26-year-old married woman who wanted to terminate her pregnancy after she found out that the fetus was suffering from certain cerebral abnormalities.

 

The judge granted the woman′s request for a medical abortion. The judge pointed out that the medical board has not provided any "categorical opinion" on the degree of handicap or the quality of the life of the fetus after birth. As a result, she stated that such unpredictability must be weighed in favor of the woman seeking an abortion.

 

Justice Singh concluded that in such cases, the ultimate decision should be the mothers.
